In June 06 I was advised of a £1000 overpayment for tax year 05/06. This was repaid (stupidly) without any query throughout 07. Jun 08 and another claimed overpayment of £500. My wife found out today it's allegedly for the tax year 03-04!!! Can they do this, should I fight it? Any advice gratefully received. I realise the amounts are small in comparison to some of the distressing cases I have read about,for me it's the principle!

Too bl@@dy right! Do go to www.taxCC.org and download a dispute pack. How can you agree to repay an allegedly overpaid tax credit when they haven't even explained properly why you are supposed to owe it? There's nothing to stop you also disputing the recovered amount, if you were fully compliant and honest, suspect (or know) it's an HMRC mistake, genuinely thought all was in order at the time, and were never told of your right to dispute. Go for it!
