An update on my nightmare with HRMC. I've gone through the process of contacting my MP and 2nd Tier complaint for 3 years tax credit overpayments totally £4,900. I have got the overpayment on 2004-2005 of £750 cleared due to HRMC stating that they would make an exception despite not finding record of my call. I still have 3 overpayments of about £4,200. The majority of these overpayment occur due to my partners income being missed of the system from 2004-2005 carrying through to 2005-2006, I had a household note of a telephone call saying that the income was incorrect but no note of the correct income. i had ten award notices, 5 of these due to changes to income but no alterations on the award notice. My MP has now replied to me saying HRMC are adamant that the overpayments are recoverable but he has asked them to recover only half of the money!
What's my next stage? HRMC have stated that I can not expect them to find records of calls in 2004 and cleared one overpayment.
Any help would be appreciated and the fact that one overpayment cleared is a huge step forward!!!!

I would keep on with your MP, there is still a long way to go, the Adjudicators office,and the Government Ombudsman, are still to go through, before your dispute is settled, so carry on fighting this,..How about getting the CAB getting on your side as well..the more the merrier..

I think they are supoosed to give the benefit of the doubt if calls cannot be traced although I have had no mercy from them!! After them telling me they had no record of certain vital calls a cd turned up, not with the calls but with a list of them which at least proved I made them! Keep pushing them. Your MP sounds like he's really trying for you which is great and congratulations on getting some of the money taken off! That takes some doing!!
