I have been dealing with an alleged overpayment.......

have now seen MP.....who was very helpful and positive.
i did go into detail so i could get advice from forum.....but its no longer relevant.
thank you again for the 1 reply received on this thread, and then also on my next. |

This is from another site, and shows early calls were not recorded, and notes not properly kept off the calls.. some were even fielded to call centres, so were not properly updated..

We knew that there were calls not recorded in the early years (Jan 03 - Sept 04) but have received assurances that calls were subsequently recorded.
The last response we had on this via the consultation group was March 08 which said that all calls to the helpline should be recorded, and only if there was a problem with the recording or retrieval equipment would the recording be be unavailable.
However, in those cases the claimant should be given the benefit of the doubt in terms of recollection of what was said.
The truth is out there.. GO get it......Non Illigitamus Carborundum

thank you robert, have sifted through the forum for the last few evenings....hence i know i'm not the only one! i had no reason to believe i had received any overpayment as i was fastidious with my contacts and updates. i also should have typed DIDN'T in previous posting when describing the shambles that was the changeover from the old to the new system!!
This situation just seems to have dragged on.......
It is an old single claim from the period before I met my husband.
After waiting over a year for an answer to my original appeal, I discovered that two letters turning down my appeal had been sent to my husbands previous address.....not an address i'd ever given the TCO, or indeed an address I'd ever lived at or been associated with. Luckily the person living in the house knew my surname, and contacted me.
One letter turned down my initial appeal (for approx £1300).
The other letter turned down a further appeal for a different year (i have since paid that alleged overpayment of approx £300 back)....although on the reasoning sheet to do with this appeal (which i received when i asked for my info)...states that the overpayment may have occured because my circumstances changed a lot in that year..(off sick from work, incapacity benefit and maternity!!).....and that because of this the TCO could have been confused!!!!!!
I'M NOW ANGRY I PAID THAT ONE BACK.
I did let them know m circumstances, i now know I am guilty of placing too much trust in them to start with...what an idiot

This may not be much practical help but from my experience it appears that the computer system is unable to cope with too many changes - I have had problems because I went into work from being off long term sick but because I wasn't registered disabled or claiming disability living allowance they said I wasn't entitled despite being having been on a "qualifying benefit" - incapacity benefit.
A combination of operator error and changing circumstances seems to have totally confused the computer system (I now work in a seasonal job so my hours change every 6 months and I have to find a second job over the winter season to continue to qualify).The system simply isn't designed to cope with the reality of people's changing circumstances - it assumes that once someone is working, they stay in the same job on the same hours for the same pay forever.
I don't know how far you have taken your appeal / complaint but if you haven't already done so, involve your MP giving him/her as much background info as poss (preferably in an easy to understand list of events so they don't have to spend too much time wading through your details to get a picture of what's been going on) and read Willow's thread in the new members section - she has got her local press involved and was on the front page of her local paper! Publicity about the shameful way the most vulnerable people in society are being treated is the best way of winning public support for this website's campaign and strength in numbers is the only real tool we have against the govt if they want to win the next election.
