Hi all
I will try to keep this brief, but I am not very good at concise!
Last month I received a Final Demand from Tax Credits for £1200; the letter basically said "you have been made aware of this debt but have chosen to ignore it, so pay up or go to court."
I had no idea what this was about, and had had no previous correspondence; when I called I was told that they had spoken to my partner last year about it on the telephone, but because he hadn't responded, then they were going to take us to court!? He is adamant that he received no such call, and there was NOTHING in writing until this demand.
Apparently this goes back to 2004 when we were overpaid, but there is no supporting evidence as to how or why we were overpaid - I was just told on the phone that we got too much money and had to pay it back at £97 per month. The person I spoke to would not give me any more details on what had happenned.
Last year, due to splitting up with my partner temporarily and claiming income support for 3 months, I received NO tax credits at all because they had me down as being on IS the whole time, AND I paid back another £1200 they had supposedly overpaid due to his income changing in 2002.
I am so disillusioned with the whole system that I don't even want to fill in a form this year in case they take back, again, what I am supposedly entitled to.
I would be grateful for any pearls of wisdom as to how I approach this - if I owe it, then fair enough, but to be honest the whole system to me doesn't seem to be fair.

The story you have told seems to be typical of the HMRC, the only letter you recieve is pay up or else..
Dont despair,, we are here to help you, along the long and winding road.. first of all you need to dispute this overpayment, the home page here will tell you how too http://www.taxcc.org./ get your sarn request going this will give you recordings of calls you have made and any paperwork you have sent..this is all FREE..
If you have been told they are taking you too court get you MP involved double quick.
Get the CAB involved and your MP.. http://www.theyworkforyou.com/
But... DO .. send back the re-newal form. otherwise your total payments for last year will become an overpayment, although you probably will be entitled too it.. the stupid HMRC demand it all back, as an overpayment..there are thousands that have sent the form back, but are lost either in the post or at the HMRC,,and the first person they blame is you.

Hi, Assumpta. Splashin, MissFroy or hxdirect will, I am sure, be along with 'horse's mouth' advice, but my own, non-expert thoughts are:
1) Why is the first sign anything is wrong a demand for payment and threat of court? Court is supposed to be a last resort! Do not, whatever you do, let them take you there prematurely. People think it might be a 'fair trial' as per our Human Rights, but HMRC are using Tax Law, which makes you completely guilty until proven - completely guilty. PLEASE DO NOT GO THERE!!
2) I really thought they weren't allowed now to go back to 2004? It must be a 'debt' notified to you within a year - I thought.
3) You must have a proper explanation for how this arose. Do go to www.taxCC.org and follow advice there - claim your data!
