Hi, I hope you dont mind me getting this off my chest. In 2003 my stepson moved in while I was in uni. I wish he hadn't now. He turned up in the clothes he was wearing. I was not earning. My husband was recovering from mouth cancer and had to get a job to support us. A few years ago the WFTC decided we owed them £1900 I have fought them over this and even got my MP involved. Finally this morning I get a letter from my MP saying they still want the money. I went to uni so I could help other cancer patients and to make sure we never had to claim benefits if my husband got ill again, plus I could be widowed and want to be able to support myself. (I'm 37). The tax credit people said they would look at it again if I had special conditions so I explained about my husband's cancer, no not good enough. I still have to pay. I explained that I owe nearly £30000 in student debt as I started my degree while my husband was still seriously ill but they still want it. They messed me about, never replied to letters and half way through an investigation they sent the balliffs round. They have made countless mistakes but wont accept this and in their last letter basically called me a liar, saying I knew I was being overpaid. My husband cannot cope with this and is still quite ill. We have been though so much and just want to get on with life but cant due to this. I am so upset about they way they accuse me of lying as I am a manager in a day hospice and am a respectable person who is trying to help people with terminal illness. If I didn't love my job I would leave this country as I feel I have had enough. Sorry to moan but honestly, they take the p*** Thanks for letting me get this off my chest!

Hi Hazel, welcome aboard. With casework I am not great - you will need PJD, MissFroy, Splashin or PFM500 - but I have a couple of things to mention. Presumably you have looked at www.taxCC.org ? This will give you a process to follow - and several stages which each give a chance of either a full or partial write-off. By disputing all the way through, you do several things: 1. Flag up to HMRC that you are an 'unhappy bunny' rather than a 'claimant happy/claimant at fault' statistic, and this in itself helps push for change - especially if accompanied by a fierce complaint copied to Brown or Jane 'Tax Credits are Glorious' Kennedy. 2. Get a proper explanation of what went wrong - since how can anyone pay back what they aren't even sure they owe? 3. Extend the process and tip the cost/benefit balance of recovery, promoting an Amnesty, and 4. Move closer towards a time when Brown gets voted out and his successor decides to put the system right.
Well worth fighting this one, since it sounds like an old error dating from 2003/4, and I'm not sure HMRC can even recover from so long back if this is the first they have told you - George Osborne was looking into that. Then you have compassionate grounds - but keep them till the end of the line.

Hi all, Thanks for all your advice, it does give me slightly more hope. Firstly, I am unsure of why we owe this money, they insist we were over paid and that I knew this and kept the money, cheek of it! I have gone through several appeals and contacted my MP. I'm not sure what he did but they replied and said they were sticking to their decision. In the last 3 years the amount requested has changed 3 times so that also is confusing. I will gladly do a case history. Oh by the way, I even emailed Gordon Brown, but didn't get a response, why does that not suprise me. In my appeal in 2006 it took them 12 months to contact me and that was only after I chased them, then they still stuck to their guns. I am just concerned that they will now send the debt collectors to visit again. I cant believe how many people have been ripped off like this.

Hi Hazel,
It sounds like you've been having a tough time of it.
Have you requested your information through a SARN request? If not do as there may well be information in there that will help you appeal further. You may also be able to get recovery put on hold whilst you get hold of your information - it's worth a go.
Is your MP actively helping on your case or just sending covering letters between yourself and HMRC?
Can you also let us know what the reasons for the overpayment given to date are?
