Hi,
I am fighting against 3 overpayments due to a catalogue of errors from HRMC (income, employers missing etc etc. I have just had correspondence from them stating yet another overpayment for £185 from 2006 - 2007 based on my ex partner not completing a declaration form. My query is this in June 2006, I informed HRMC that I had become a single parent and the joint claim was finalised and a new single claim started. I have signed my declaration form, should I be liable for a declaration form not being sent by ex as the joint claim had ceased in June???

The joint claim ended in June 2006, so from April 2006 - June 2006 you received payments on the joint claim. You then ended it and started a single claim from June 2006 - April 2007.

Both claims have to be renewed so it the summer of 2007 you should have received 2 sets of renewal papers. One relating to the joint claim and one relating to the single. Your ex-partner should also have received a renewal form for the joint claim.

Because the claim has joint and several liability, if one person does not return the renewal form then the claim is not renewed and therefore is terminated for non renewal.

So I think the answer is yes, because legally you are jointly and severally liable for the joint claim from April 2006, even though this seems incredibly unfair.
