Hi.

I wanted to get some advice on overpayments.

I'm already paying back several overpayments from last 3-4 years ago which they demanded from me last year. Now I'm paying £50 a month until 2018!!

I'm still receiving tax credits and they're still coming up with new overpayments. I want to get out of the loop altogether and stop receiving them once and for all. But how can I do this.
If i close my account so they wont be able to pay me will that work?
I hope somebody can help.

I'm inclined to think that it will not work.

In my own case - which I won - we returned their cheques to them so we never received a penny from them, but that didn't stop them from threatening to take us to court for the (alleged) overpayment!! (bloody idiots!!)

In your case, I would be inclined to stop paying them anything and dispute everything - until you are absolutely sure of the state of play.

I think you should write to HMRC Tax Credits and tell them that you are disputing this matter and until it is resolved you will not pay them a further penny. Sent the letter by Recorded Delivery, and do everything in writing. A telephone call isn't worth the paper it's written on so don't do it - unless perhaps you record the conversation yourself.

My next step would be to obtain from HMRC all the info they have about you & your case under the Freedom of Information Act. This is done by completing a SAR which you will be able to download from our main site here; http://www.taxcreditoverpayment.pwp.blueyonder.co.uk/

When you get to the main site, the first thing I'd like you to do is SIGN THE PETITION - you will see the link to it - then click the link FREE TCC APPEAL PACK. It is here that you will download the SAR form. Fill it in and post it by Recorded Delivery. In return, you should get print-outs of all their computer activity on your case and you should also get CD's which contain recordings of telephone conversations that you have had with them.

Be prepared for a parcel about the size of a telephone book full of papers that appear to be complete gobbledygook to us mere mortals, but don't worry because we have a secret weapon here in the form of someone who can decipher it for you!

Don't be surprised if you find a recording of a crucial telephone conversation missing either. HMRC are quite "selective" about what they send!!

In my experience, this "organisation" is probably the most corrupt that you are likely to find outside Sicily!

Meanwhile, instead of sending this bunch of bullying gangsters masquerading as a trustworthy, efficient, competent and honest Government Department £50 per month, put it into a savings account where it will earn you some interest. Later on, when you know for sure how much you really owe HMRC, you will be able to pay them from this savings account that has generated you some interest!

Finally - for now - keep a record of all your expenses incurred in this case - postage & stationery, telephone calls, travelling expenses (to the CAB, Tax Office etc.) because when you win your case, you are entitled - under HMRC's rules - to be re-imbursed (by HMRC) for these.

OK that's all from me just now, but others will be along soon to offer their twopennorth!!

If you end your claim they will demand it all in one go. Have you had a single and joint claim?
