hi i was told 2 weeks ago we had been over paid tax credits by £2500 (my fault as i under estimated our earnings) so my payments went down to £4200 per year but this is where i am confused because they are basing this on lasts years earning we were earning £19000 but this current tax year we have only earned £12000 as i no longer work and have not since march 2007, so i rang them up last week and gave a new estimate of earnings (i over estimated it by around £600) so they told me by phone my payments are going up to £7300 per year my questions are..

1) will i have actually been overpaid if my award was based on us earning £19k when we only earned £12k (max)

2)or will they owe us money

3)can anybody help me to understand i aint very bright lol

Hi Nicolefrenzy, and welcome to the club no-one wants to join! I wish I knew the answer, but I am sure someone will be able to advise you, and you can always click on 'home' above to get to the main website, where you can find Paula Dean's contact details (I think it's a 'Contact TCC' button on the left). Common sense would seem to suggest that the one would cancel out the other, but this is HMRC we are talking of, who won't let me return as unwanted, and have just sent back to me, cheques for £546 at the same time as they are threatening me for £723 allegedly overpaid. They would rather spend money forcing me to accept what I don't want, and more money trying to take back what they told me was mine! So they do not exactly take the logical course of action to make life easy all round, but seem to be a law unto themselves.

I don't think it could hurt to ring the so-called Helpline and ask them these questions. If they reassure you that you owe them nothing, I would recommend writing down what they told you, what the Advisor's name was, and the date and time of the call. You may need this later. If the news is not as good, and you have still ended up overpaid, don't despair, but follow the Dispute process from the main website. To be honest, they could not run a night out in a brewery, and I wouldn't trust them to make a cup of tea. They may have overpaid you, they may even have underpaid you, and they really need to be explaining to you exactly what they have and haven't done. Okay, perhaps you didn't quite manage to hit upon your exact earnings, but it is very difficult to exactly predict them, and the system is overreliant on people making accurate predictions, constantly advising HMRC when there is any deviation from this, and HMRC constantly revising and finalising awards - which in itself causes massive problems. That's without them sitting on information and doing nothing with it, or zeroing our salaries time and again! Paula is better at understanding and explaining this than I am, so I would give her a call or email.
