Christmas week I recieved a letter from HMCS stating that I had been overpaid by £1065 in 2003/04. The letter stated that they had written to me before but I had no knowledge of such letters. When I challenged it (with the help of the wonderful templates on this site) I was informed that I had not told them of my change of address (I moved house in August 2004). This meant that I could not dispute the matter, according to them. I wrote to them to inform them of my new address just as I did my bank, employer, son's school etc etc but as it was almost 4 years ago now I do not have proof - I have not claimed WTC or CTC for a couple of years now as my son is almost 19 - I cannot find any correspondence or proof of payments. I am seriously worried that I cannot fight this - I am trying to write a case study but am finding it extrememly difficult with no paperwork to go on! I struggle to make ends meet as a single person and would welcome any advice you guys might be able to give me.

Hi Marie..

Click on the home page above, and go to the other site there you will find out how to dispute this overpayment.but the best thing would be to get a sarn request, this should give you all letters forms and paperwork concerning your awards..

i am sure more people will be along to give advice also..

Thanks Robert - I have done that and received a load of screen dumps and that is all! No record of telephone coversations (and I know I had them as I always had problems with claiming!) I could find nothing of any use in the info. I seem to remember that my payments were stopped due to a £600 overpayment (probably around 2003) but there is no record of this either. I just think I may be baging my head against a brick wall as I have no evidence to fight them with!

Right, it is obvious to anyone with half a brain that you cannot properly evidence and pursue your dispute without proper access to ALL the papers and calls relating to your case. So write a stern letter and 'cc' it to all parts of HMRC which are sending you letters (it's possible to get them both from the Disputed Overpayment Team, ironically named 'Customer Support', and from 'Debt Recovery') as well as to your MP. Insist (s)he takes up your case. We are seeing a lot of this - HMRC insisting on repayment whilst the claimant is very obviously preparing for a dispute. Sometimes court is even threatened, though HMRC swear to us that they don't do this except as a 'last resort'! It is all bullying tactics to grind you down and ensure they win, thereby making their recovery figures look better to Parliament. Resist! They haven't a leg to stand on. Send the sternest letter you can muster, and having cc'ed it to any supporters you have (MP, Paula Dean, Tax Credit Casualties, LITRG, CAB, etc.), then send it recorded delivery to HMRC.

This should suffice to get the demons off your back for a while.

Thank you for your support - I am now in battle mode again! I have written my stern letter (cc to TCC and my MP) and will await a response.

Once again, thanks - you really are an inspiration!
