Hi all,
I've followed the quidelines on appealing my overpayments (4 in total). I have gone through the whole TC846 form for each one and had them rejected. I've asked for my information via the SAR and received computer information but not phone calls. Some of the codes have not got a descriptions and I have found two alerts on my case notes saying This case has been affected by the running of TT508015 in 2005. Has anyone else seen this and what does it mean? Just to give an example of the sheer incomptence of the system, one of my overpayments is due to the system saying I was not responsible for my child and not entitled to the claim for that year. HRMC will not accept that I have been always been responsible for my child and will not accept that this is a clerical error and surprise surprise there is no record on my case notes from where this incorrect information came from!

sorry i dint have a clue to the codes..but hopefuly Splashin will be along to help soon..
keep looking back...
or possibly ask the local CAB. they may have a list, of what these internal codes mean.but knowing the HMRC it is probably all to do with the official secrets act..or a code meaning we made a big error..but dont tell anyone..

You say that one of the overpayments is because HMRC say you were not responsible for your child when clearly it seems you were. if that is the case you should not be disputing this overpayment - you need to lodge an appeal against entitlement.
If they say you are out of time for an appeal, argue that your first dispute (presuming it was less than 12 months from the last notice informing you they removed entitlement) should have been treated as an appeal.
The TC846 is for disputes where you ask HMRC not to recover an overpayment. There is no argument that such an overpayment exists.
An appeal is against entitlement. Success means the overpayment disappears because entitlement is reinstated.
The most important difference is that if time limits are met, appeals go to an independent social security tribunal.

I agree the office who would settle this type of appeal would be and is (in my opinion) an independent office. They usually deal with any social security appeals, well for everything really. And I believe they are a very fair and professional office when they deal with these matters. What does worry me is that, this office knows of correct entitlements etc, etc but has know working knowledge of the system itself. They really go off what HMRC tell them. And if the information they get from HMRC is incorrect for them to make fair judgement on cases, they would know no difference whatsoever. You will have probably have seen it yourself, claimants who have full eligibility but the system tells different.
