on-going dispute re alledged overpayment, then became aware of the illegal recovery issue. So added this to our case - have written to HMRC about the issue of illegal recovery as they failed to both act on information they had for 2 yrs or notify us within the following year of the overpayment. Of course no reply has been forthcoming,
Has anyone received an answer to this point? Paula have your requests to the Treasury produced any kind of answer to this specific point? Also have the Conservatives taken this point up?
On the face of it this point may represent our best chance of winning our case – really grateful to anyone who can comment on it

Hi Kerryg, sorry your post seems to have got buried and left unanswered. I will see if I can find out from George Osborne. Good luck, and hang on in there, as PERSISTENCE is key.

Hi Guys, any feedback yet - if the question of illegal recovery stands then on this basis alone we are off the hook and the claim of overpayment will have to be dropped, as our claim amounts over several years to being over 20K I am naturally very keen to see if this issued has been confirmed or tested

Why has no one yet made an official complaint to the police that HMRC are committing theft according to the Theft Act 1968 s2b of our right to .... (a fair hearing)....by deception of authority because they do not have an honest belief in their authority as they are unable to show it to me as is there duty according to Metropolitan Asylum District v Hill (1881) 6App Case 193 my rights being my tradable property according to Curry v Misa 1875 and every one of my rights is protected by the ICHOR TRUST Covenant as notified to the Queen and the Prime Minister and if the police do not properly investigate this attempted theft then the police will be damaging our property, rights being property, which is also a Terrorist Act according to the Terrorist Act 2001 wherein the definition of a terrorist is a person who threatens to damage or actually damages property, my rights being my property. Thus, we have the right to expect the police to investigate these serious allegations immediately because we believe Government has been infiltrated by terrorist’s hell bent on damaging our rights in order to cover up their terrorist activities.

Hi I'd be interested to see what comes of this too Kerry as my claim is from 03/04! They have told me twice that I don't owe the money only for a nasty letter to turn up a few months later! |

If "They have told [you] twice that [you] don't owe the money", then you were quite reasonable in thinking your award was right. Challenge them, and trace the calls/letters telling you that it was right!
