My tax credits claim for 07-08 has been under an enquiry since October last year. I have been very co operative and gave all the documents they requested. however through a credit check they have found that i have a joint mortgage with my childrens father. Its a long story but basically i needed 2 incomes to get a mortgage so he helped me out. I have supplied tax credits with proof of his actual address like his bank statements etc but they still say they have enough to prove he lives here! We are currently back together and i told them this and that i was hopeful he would move in. since then they have hounded me to see if he has moved in yet. Ive told them i would inform them when he did but it probably wont be happening for some time. They have rang me again requesting his driving license and stated if they did not have it in 2 weeks they would be making their decision which at this point is most likely that he has been living here. so im going to get done for fraud and ill loose my job cause i work for the child support agency. I am trying to work out whether to bother sending in his license it will show is other address but im so fed up giving them more things and he is fed up with me asking for his things. So basically im going to have to appeal this decision when they finally tell me even though theyve been planning on this out come the whole time. So how do i appeal and how likely is it that ill win?

Have you posted on here before?

You will have the right of appeal once HMRC make their decision. i would suggest you comply with their requests as I personally think it would look better should you go to appeal.

No-one can tell you whether you will win, simply because this is a very gray area of law. The test is not straightforward. Lots of things have to be considered.

Does he contribute to the Mortgage as well as having it as a joint mortgage in name?

You should definitely comply with their requests - however infuriating you find them. If you don't, they will conclude that you are deliberately withholding information because it would harm your case.

Just as they seem to "deliberately withold information" from us because it may harm their case!!
