Hi there, i have been fighting with tax credits for 5 years. every time i sort out 1 year, i recieve a demand for overpayment for the following year. I only made 1 initial claim and spent the next four years trying to get off the merry go round. I have got as far as recieving my data, but it is confusing, and doesnt really tell me anything. I expected all corespondence and lists of phone calls, but got thousands of pages with a photocopy of a computer screen and thousands of pages with our details on. We recieved a letter from them in 2005 stating thst what we owed was so small they would not be asking for it back! Now in 2008 they want over £5,000 from us. naively i sent this letter to them when disputing overpayment in 2003/2004 to which they had got it wrong and had underpaid us rather than overpaid. I expected to be sent a copy of this letter along with all others and copies of forms which we have filled in every few weeks since 2003. does everybody else get copies of letters and phone calls? i dont know what to do next because i cant make sense from the data recieved. There reasoning for the overpayment is that we did not tell them quick enough about a change of circumstances, we dispute this and is why we need copies of letters etc. Please help/

Hi Stronger,

It is scarily common for errors to be made year on year.

I would recommend that you re-apply for your data, stating that you are requesting ALL your data including copies of letters and CDs of phonecalls.

Also write to HMRC reiterating that you are continuing to dispute but need to have your data request fulfilled before this can be progressed and send a copy of the letter to your MP with a covering explanation. There are template letters in the step-by-step guide of the main website. And remember to send everything with proof of postage.

I know most people are bemused by the reams of, what seems like repetitive information, over and over again, but please don't be. This is going to be the best tool you could ever use in disputing this overpayment. Hopefully, you will have kept in same order as it arrived, as it is much easier to work through. But not to worry if you haven't, you will just have to re-group each section again.
The printed pages with details of App1, App2, Children, Work, Income, Bank Details are really usefull. These sections will be part of 1 award notice, make a change to anything on the claim, it recalculates and produces a new set of details again in every section, then this produces a new award notice.
O.K. Now back to your dispute. If you can give me some more background I will be able to tell you were you need to concentrate on your SAR documents. You say you get one year cleared only to then get another demand for the year after. This says too me that the initial problem has not or never been resolved.
HMRC must reason why this overpayment occurred, can you remember or recall anything which may have made you overpaid?
Are you eligible to get tax credits now?
When you got the first letter in 2005, what year was this for? What did HMRC say, with regards to how it occurred, also reason for remitting the amount?

The more background you can give the easier it will be for me to give you some reasons as to were your overpayment occurred, or at least where you need to concentrate on the documents. Remember here on this forum you are anonymous, so please do not feel like you have to hold back. Even if you may think you have done things wrong, thats usually not the case when it boils down. HMRC make you feel as if you caused the error, and will keep doing so unless you point out the facts to the. Even if they can see there are errors (their doing) on the claim, they would not tell you of them whatsoever. This is within the tax credit manual, which is what the processing staff are supposed to follow. It clearly states they should not disclose any findings unless the claimant questions them. How wrong is that I know. So that means unless we are committed to revealing these faults, and start with the clear thought, that you must see it through until the overpayment is explained to you in full, so that you can see where you went wrong (if it was your fault) or a full remit on the amount outstanding because it was their error.
