Hi I wondered if someone could advise me, and also if anyone else have been in this similar situation.
My biggest mistake was to call the Tax office for advice.
I needed to inform them that my circumstances were changing as my partner was moving in with me, this was happening around about the same time that I needed to complete the annual review form for 2006-2007. For some reason, I was confused on wheather I should complete this form, which is only going to have my details, or do I need a different form to include both mine and my partners information. I thought the best person to stop me being confused over something that is really quite simple is, of course a person whos works at the Tax office.
I called and explained to them about the changes and when this was going to take effect, and then asked them "do I need to feel out this annual review form still" the reply was "no". They said they will send me out a new form so I can include details of me and my partner. Ok, I said, happy with the help given, I awaited for the new form to be sent, and shredded the annual review form. New form arrived filled in details then sent it back.
Nearly a year later they write to inform me that I need to payback an overpayment of £1,850, the reason being is because I did not send back my review form for the tax year 2006-2007.Tried to explain to them that I was informed by a member of their staff that I was advised not to, because I needed a new form.
They sent me a form to dispute the overpayment, which i completed, but was rejected and informed I still need to pay and I can not appeal against the descsion.
That was ealier this year, I had not heard anything from them since untill last Thursday, when they contacted me twice in regards to paying the amount back. My second phone call was from the debt collectors, which shocked me as I never received any type of correspondance in giving options of how to pay this back, or a from regarding my in coming and out going amounts. But, I can now see that that was me not thinking again, I was informed my the tax office later that day, I should be contacting them in regads of paying the amount back.
I then asked for a break down of how they figured I was overpaid for that year, when i was a one parent with 3 children, not able to work at the time as I had to give up my job in order to become a carer for my youngest son. She told me that there is no break down, i need to pay back the whole of that year, due to the form not being sent in for 2006-2007. Again I told her i was advised not to.
On this years tax review which we were sent, Both me and my partner filled in the 2007-2008, and also i was reguested to fill in the details of my tax year 2006-2007 on the same form. I inform the girl of this as well, she told me that " they can't except that, as the claim is for a couple and not a single person".
So now I am worried sick on how I am going to pay this back, but more importantly why should i pay back money, that i needed to feed, cloth and house my family, due to wronge advise given to me by someone who should be trained in giving the correct information dealing with enquires.
And, I do not have that persons name, can not remember the date only that it was in March, so there is no proof I was told this.
Also, I have read that they never write off an over payment regradless if it was their fault or not, as I don't have any proof is it worth me fighting this.
I so wished I never listened to that person, cause now I can see and understand that i did need to fill and send that form in, back then I did'nt know.

Hi..
you can still dispute this,click on the home page link at the top, download a dispute form,/pack. and get a sarn request going, this will give you calls and paperwork, and is FREE..
your case is good, as you were advised not to send back the form, for that year as you wee told, by an HMRC employee, that you needed a different form..so you were given the wrong advice, by an HMRC employee.. which is standard crap advice they give..
when your calls arrive, from your sarn request, dont be surprised that the call the HMRC employee told you to not complete the form is missing..it seems to be standard practice not to send you anything that puts them in the wrong..it is also a good idea to get your MP involved in this as well..
