Can anyone advise the best course of action please? We have had a letter through this morning saying we owe £2936.00 in overpaid tax credits for the period ending April 2004. We've not claimed any tax credits whatsoever since Jun 2005 because at this time we had two letters from the IR through on the same day both giving completely conflicting information. One said we'd overpaid and were not due anymore credits, the other said 'you are elligible for tax credits please apply'! As we were completely confused, and rightly so, about what we were and weren't eligible for we just didn't bother filling out anything in the end as no-one at the tax office seemed to know what was happening either, and so we haven't claimed anything at all since Jun 2005.
We also had no idea that we were being overpaid during this period, and all the information given to them was 100% correct and accurate given our finances and work situation at the time. I've also just had a look at their website and entered the 'eligibility page' and found that we could be claiming £100pm based on our circumstances now!! What should we do now??

Hi

A familiar story I'm afraid. Sounds as though you need to find out what's going on by disputing recovery of the overpayment. If you go to the main website www.taxcc.org and click on the link to the Dispute Pack you will find all the information you need. If you still have the two letters you received earlier that will be very useful.

Others will be along I'm sure to add to this but hope this allows you to get started. Don't agree to pay anything unless or until you are satisfied that you should do so.

Hi Joeanalex and welcome!!

I have just one question for you before I go any further and it's this; Are you prepared to copy & paste a letter and either post or e-mail it to your MP?

There are only two answers to this question; YES or NO.

Hiya Joenalex,

HMRC have a habit of confusing anyone who doesn't have a Masters Degree in quantum physics!

As Auntieh says, you need to get going down the Dispute path. Please keep us up to date with what's happening with you, by posting on the forum - you'll also get speedy answers to any query or questions that you might have.

Don't give in - and don't pay them anything!
