If the compliance officer told you the Helpline do not ask questions, she was - to put it mildly! - being inaccurate. I have listened to quite a few CDs of calls and it is quite obvious that they do ask questions in order to clarify what the caller means.

You say the second purpose of your call was to tell them your child had started school, but I assume your reason was really because you knew that this would result in the childcare stopping - why else would you have told them this?

I cannot see any justification for a penalty here, although you may find you have to pay back the overpayment as you didn't pick up the error on the award notice. However, go on fighting it - and do get the CD of the call. Ask for the recordings of all your calls now - don't leave it till you get their decision.

I didn't pick up an error on an award notice, and eventually I got my overpayment written off, so it can be done...

Go for it. If you were honest and compliant, to the best of your ability based on what you knew then, what is there to lose?

hi ya

for my (late) 2 pennies; any penalty they impose for 'negligence' can be Disputed (if not Appealed) as well as, or separately from the original overpayment. i don't usually find them too eager to chuck penalties around, (your visitor might just be one of the 'hard heads') so if penalties etc do come up, on top of any overpayment, this can be disputed as not negligent. the fact you rang proves that, without even getting down to semantics.

Thanks everyone...am still awaiting the final decision and will update you all accordingly...I intend to dispute the penalty whatever it is and so will request the calls as soon as i can

I do really appreciate everyones opinions, advice and support...this is a great site and i woulda probably crumbled had i not been able to come on here and winge...cheers guys/gals
