HI
My problems started in september, when i recived a letter from tax credit asking for my house bills, house contracts, phone bills , bank statements, letters and invoices from my daughter nursery.I have gathered everything i could, except the house contract, as i live with my daughter in a shared house, as i can not afford a flat on my own.I called them , explain the situation, and they said to me to put a covering letter explaining my circumstances.Done that and send it over.recived everything back one months later, saying that my payment will be stoped, as HMRC considers that i have a partener living with me at the same adress.Contacted them the same day, reexplained to them again, they said there is nothing they can do , only appeal, as my daughter father still has hmrc corespondence there.What can i do if he hasn't changed his adress.he moved out over a year ago, when he bought a house.Luckily we are still friends, talked to him, he gave me a few bills to send over to prove that i am not lying.I appealed, called them 2 times, letter lost in post, resend it by special delivery, confirmation letter recived that i will get an answer by 12 march.
I have already contacted mi Mp who wrote to them on my behalf.Still waiting to see someone ai citizen advice bureau.My question is...I am now expecting to have my second baby, in 4 weeks time, just recived a letter asking for an overpayment of over 6000 pounds, on the phone they said to me is over 20000, i have only my 498 pound income from my maternity leave.Still single, not a partener to support me, 500 pounds barely covers our rent and food, what am i gonna do?Not to mention that i have a loan and a credit card.Is there any chance they can reinstate de payments, untill the appeal is heard?Is there any way we can hurry up the proces?I feel like crying only thinking that the Chrismas is coming.My babies shoul not suffer for what i have done.I am studying for a degree in accounting, close to finish, now i find myself in a position where i should give up as i can not afford to keep going on.My sister keeps helping me out, but untill when?

Did you send the appeal to the normal appeals address? (Tax Credit office, Preston?) or did you appeal against the decision letter from the compliance officer and send it to them. It is often quicker to do the latter.

You sound like you are doing the right thing with your MP. If your mayments have stopped you should certainly get a decision before March.

You could try and contact other groups like LITRG or TaxAid to see if they can help and obviously CAB. However, it is best if you choose only one so either go to CAB or contact one of the other groups as it can get confusing if several people are involved.

It sounds like you have evidence that your partner is living elsewhere. Were you married to him?

No, we were never married, i have the proof that he was not living with me, i already send it with my appeal, i have send the appeal directly to preston, as this is where they have advised me to do.But looking throw this site, and seeing haw long it can take to resolve a case i do not know where to go any more.Even when my son will be old enough for nursery, i will not be able to afford childcare so i can be able to return to work.I am already strugling, and march seems so far away.

This sort of thing makes me so angry! They really should be looking at all the factors involved in deciding whether you are a couple - & not just at whether for some reason he happens to still have some financial connection with your address. Go here, which is part of their Compliance Manual:

Look particularly at part CCM15040 & the other sections linked there. If this case does have to go to an appeal hearing it will be very helpful for you to have information & evidence about all the factors.

I hope your MP's letter helps. If you are still waiting to see CAB I suggest you ring LITRG on Monday (get their number from their website). They have a very good welfare benefits adviser who may be able to raise your case at a level where it can be reviewed rapidly.

thank you.will do so on monday morning.Keep trying the Citizen advice bureau but for some reason the adviser is always busy, been there, he said to me to call before.
