Dear all, I have been given 6 weeks to raise/sort out my TC dispute and call the collection department else?? Pls help. The dispute is regarding my wife being disabled which I told them about and insisted that I do not want a single penny over paid. When I received the award notice the information were correct and showed my wife having a disability. Over a period of time I kept getting these award notices specifying that I was entitled to a 'disability element' of wtc. Then I started getting notices that I was disabled, I called them and told them that it is not me but my wife who is disabled.
I am being asked to pay back 2k plus, which I do not have. I raised a dispute and was asked to send the original award notices which I did. I have not received these documents back and need to contact the debt management deptt. within 5 weeks, I am panicking, please help.

1. Rule number 1. Never ever send original documents to tax credit Office. Always send copies & keep the originals.
2. As you are in contact with the debt management dept. I assume you are no longer getting tax credits. If you do have to pay them back they will accept payment over 12 months without a problem, or over 3 years with rather more enquiry into your finances.
3. You don't say whether you have had an answer to your dispute. If not, they should not start trying to collect money from you until a decision has been made. If they have rejected your dispute then you can go on to a higher level dispute if you have some evidence which they have not considered. It might be worth you getting some advice from your local CAB. |

Thank God, many thanks for the response.
I somehow sent the originals, I did scribble the serial numbers of the documents and have been searching for those, it has been well over a year between communications.
The time period I have been given is to raise a dispute. I am puzzled as I think I did this over a year ago. In response the letter said something like 'you were not entitled to the money' hence they want it back. But in the first instance they told me I was entitled to it
I have found one award notice sent to my wife with the initial detail, apart from that I have nothing else, can I ask them for the transcript of the phone calls. I really don't know how to deal with the situation. thanks in anticipation, seb |

| Go to www.taxcc.org and look at the disputes section. Follow the advice there. One of the things you need to do is a SARN to get a copy of all your paperwork and a CD of phone calls. |
