Hi, weve been overpaid because when we moved to france in 2006 Tax credits kept paying us and sending letters saying they still owed us money despite us replying that we had left the country it wasnt much about 40 quid a month but they want 697.61 back Last year we agreed to pay it back (I think only about 10 pounds a month as we are really struggling to make ends meet here) sent the forms off and thought no more about it The payments were meant to start in August last year but never did, today we got a warning of legal proceedings and looking on line I stumbled accross this site and thought do we actually have to pay this back, they made the error! We closed our restaurant business at christmas and are trying to get on our feet with new jobs here but we are struggling to pay of french debts never mind UK ones. Should I start action against the demmand???? Would be interested to hear from other expats with this problem;
If you want to fight it you need to do a SARN request (look at taxcc main site disputes section) & get all your paperwork & CD of calls. If you notified them at the right time & can prove it then you have met your responsibilities & they haven't met theirs, so you should not have to pay.
Meanwhile, write a dispute letter & also ask that no further action be taken until the dispute is settled. Tell them you will provide more details when you get the paperwork etc.
we have had many expats contact us over the years and i'm sorry to say the approach HMRC use has been very inconsistant each time (no surprise there then!)
