Hi all this is my first post on a forum i am having proplems with tax credit. the story goes like this when tax credit was first introduced i was on low wage two young kids and wife and we claimed taxcredits all ok. in 2003 i got a well paid job and my wife was working part time we claimed tax credit informing them of change of job etc. they awarded us a claim i did not think we would get one due to new jobs etc so phoned and asked they said it was right.a few months later they said they have overpaid but they will deduct the money from the award. i heard no more from them and did not claim again.then in oct 2008 ! some 5 years later i get a leter saying they want 4500.00 back in overpayments for the year 2003-2004. i write and have appealed.from what the return letter says they have only took my wifes income into account and awarded the payment based on that.they have said that they have me down on their records as working full time but a salary of 0 !!! how can this be i now have a letter for legal action to get the money back help what can i do now

hi all
still need help as per previous post i have just spoken to the overpayment unit he says that my income on the claim is blank and has been recored as nil thats why they have overpaid but says its my fault as i did not inform them when i recieved my award notice.we did call and tell them but he says there is no record of the call i dont have any copies of anything it was back in 2003 he said that they dont have any copies of the award notice how can they say its my fault when i have put on the claim form i am working full time but recorded nil income please advice what to next thanks.

Hiya, again.

If they have no proof, how the heck can they say it was your fault!

You don't say whether you have officially begun your dispute with them yet. The telephone operatives at the TCO often give out wildly inaccurate information - so that their jobs are easier.

Initially, I would recommend that you officially begin a dispute. Go to http://www.taxcc.org/Dispute_1st_things_1st.html and follow the dispute steps. You should easily be able to get steps 1 and 2 going - step 1 will let them know that you are disputing (so they should suspend any kind of hassling letters or recovery), while step 2 will provide you with all of the data that HMRC have on you.

One thing that used to happen a lot was that they had a computer glitch that just happened to set peoples salary to zero. The data that you get from them should show if this is what happened with your claim.

hi thanks for the info when i first got the letter in oct 08 telling me i had been overpaid. i replied in a letter stating the history of my claim. i recieved a letter back stating that i still had to pay the money back.after speaking with on helpline today they are sending me a tc846 to fill in and they said phone the recovery unit and tell them you are appealing i did this but they said they will still continue to recover the money until they are told by another dept that the have recieved my form.
if i get all data from them will they have a copy of the award notice? what if there is no record of our telephone call? its our word against theirs?
