I would really appreciate some advice. I rec a letter 2 weeks ago from tco compliance team for the details of childcare providers,bank statements,mortgage,payslips etc for the last year. I sent what i had straightaway and advised the chap who is dealing with it that i could get copies of anything missing.He has been very nice on the phone to me so far.
Im married,got 3 children and baby no4 is due in a few weeks (his baby). Ive been living on/off with my husband. For the last year he has been sharing a flat with his friend,all his belongings are there,most of his mail and bills go there too.His name isnt on the tenancy agreement though or council tax register. We used to have a joint account and his wages go into but for the last 4 months he has had his wages paid into his own account,paying me a standing order for maintenence and is not named on our joint account anymore. His name on mortgage still.Cant just take his name off.Ive never earnt enough to buy him out.House isnt an issue. He stays here 2x a week now as im having problems with my pregnancy.I informed the compliance officer of this a couple of days ago. He said that was fine but if he contributes towards house or moves in permantely then to inform him within 4 weeks.There is a high chance that i would like my husband to move back in at some point.
Have i been claiming correctly? Am i naive? Are you allowed to have a relationship even though they dont live with you? I always thought that maintenence for children doesnt have to be declared?If they decide that we should of been claiming as a couple the how many years would they go back? I could end up oweing them thousands? The compliance officer has told me not to worry but he will be ringing me next week after looking at my documents and that he will have questions for me. I know the fact that we did have a joint account with his wages going in doesnt look good but i got money for the kids that way and husband took the rest out. Ive never had my claim investigated before,got baby due in a few weeks and i am worried,of course hormonal too! Sorry for lots of questions and such a long post. x

I think your question about have I been claiming correctly, is really unanswerable by any of us. This decision will lie with the compliance officer dealing with the case. But I will offer you my opinion on the matter. From your post, I see you as a compliant person. You have submitted the relevant documentation requested by HMRC and offered if anymore needed, you will source them. Your financial ties to your children's father, can be explained and understood as valid reasons for this attachment. The only thing that may come out of it, depends if you work or get benefits, if you work and claiming tax credits then the maintenance you get will be no problem, but if getting benefits then this should be taken in to account, and that could raise some issues with DWP. All I will say is I think you have done the right things so far, since being contacted by the compliance officer and you must continue with this. Please just wait for the officer to contact you accordingly, more than likely after baby's born, and who knows what he's going to say and ask until then. He may not find a thing. If you feel you have done everything right, then stick by your guns and wait for them to come and tell you what it was.

Thank you for your reply. Yes,ive been working continuosly for the last 10+ years. The benefits i claim are ctc and wtc.Nothing else. |
