Hey everybody, both me and my partner work but we have been told that an over payment has been made to us because the tax credit office had me down as non earner. I called them and they say it is an error made by us and we have to pay the money back. The thing is we have a 'Tax credits-Annual review for the year ended 05/04/2008' form which clearly states i 38 hours a week and my partner 50 hours.!?

1st thing, is to dispute this overpayment,if you click on the Home link at the top of the page, this will tell you what to do, how to get sarn information from the TCO office,, all FREE of charge.and then you can uncover al the errors they may have made on your award, get disputing..

Aye - it's all free of charge, but we really would appreciate a donation no matter how small to elp the fighting fund.
We intend to take HMRC to court & need a bit of cash to do so.

| Make sure you let them know you are disputing. Until my mp got involved they were sending me court threats while telling my mp that they were looking at my case! Don't let them hassle you either. It will take time to get SARN documents and go through them!Follow the process as laid out on this website. It worked for me!! |

| Hey guys, i checked my paperwork and there is no evidence of my income only that i work 38 hours a week. I remeber telling them on the phone how much i earn, will they have kept telephone records. Also in your opinion do i have a strong dispute that it is their error?! |

"in your opinion do i have a strong dispute that it is their error?!" I would have thought your case would be strengthened by your having phoned to tell them your income, certainly. Have you already sent a SARN request, or is the paperwork you refer to what you already have at home? If you haven't made a request, go to www.taxCC.org and click the buttons for the Dispute process, where you can download a form. If they have sent you paspers with your SARN, but not the phone calls (which happened with my case), you can insist these are sent. It may take time, but they will eventually come through. All being well, the crucial call will be on (one of)the CD(s) they send. If it's missing, there are still things you can do, although of course it is better if the call is traced and provided. The key to winning your dispute is to not let HMRC grind you down, and only ever in if you are convinced you were at fault - and I don't mean misled or not correctly advised by HMRC, either. If you believe you did everything you thought you had to at the time, don't be afraid to stick to your guns and win this. It can be done!!
