My saga with WTC is further down the page, but basically, I have been tol dby WTC that I owe £2500 because I never infomred them of my partner living with me. They say that they have listened to a phone call on 7th Nov 05 where I do not state we are a couple. Anyway, requested my data and this particular phone call was not on the CD. I rang data compliance and they said that the tape was irretrievable and I should ask myslef why WTC have deleted it, I guess meaning that there is some dodgy goings on afoot. Anyway, to further cover my back I wrote to Data Compliance to confirm this tape is irretrievable and I sent the letter on 3rd Sept. On the template I used from this website it states that I must give them 10 days to acknowledge the letter. Its been 2 weeks and no reply. What action do I take now? Do I contact them and aske where the response is or do I wait longer? I have contacted my MP and am awaiting his reply but I want as much evidence that I don't owe this money as I can get hold of, and surely if they have no tape, I don't owe it. I also have another converstaion on tape where I do state I am living with my partner, so I'm not worried about paying it back as I have proof but I want to prove that WTC are fraudulentley demanding money back from innocent people. Any advice would be great. I feel I am getting further everytime I take advice from this website.

Hi
You certainly now have grounds to complain to the Information Commissioner. The Information Commission monitors all data protection and access in the UK - not connected with HMRC in any way. www.ico.gov.uk. Click on the link for complaints.
Copy your MP in to the letter. Good luck

How can the TCO office of listened to the call concerned, when the data comliance team says they can not retrieve the call??
Someone is lieing.. get your MP to question this as well..

Hello Miss
I am a little confused by your story. Were you claiming as a couple or as a single person at the time of this missing call record? If it was a single claim have you after this date put in a joint claim?

Hi Missgelfling. Just quickly - as I am chasing my tail and running late - do consider going via www.taxCC.org to contact Paula Dean (see the Contact section), as if you have a strong case, she may be able to link you in with the Child Poverty Action Group re a test case (legal action which would be free for you). There's a big issue at the moment with single/joint claims and how HMRC are making a bigger event of this than they should... For more, please contact Paula. Can't post her details here because of the orgy of spammers which will result!!!

I'm about to contact data compliance for a third time! They have answered within 10 days but... First time...only 2 calls could be found. Second time..They managed to find another 6!! Still some missing so they are getting another letter today. I wrote to the TCO in April asking for answers to questions I finally got some last Friday, but not before my MP had become involved. Get your MP involved. I'm going to write to Gordon Brown just to let him know how these people are destroying peoples lives. Keep up the fight

In my expierience I would not put much hope using these recordings, to dispute your overpayment. But if HMRC have listened to this call, why can't you? Please can you tell me some background on the November dates. What was the purpose of the call made on the 7th November. What were your circumstances at this time and also what date was the call made when you did mention your partner?
