Posted - 14/02/2009 : 15:01:02 hi can anyone point me in direction of next letter to send... i sent of the form stating why i thought it wasnt my fault ect and recieved a standard reply saying its been looked in to and its not thier fault and i cant appeal....i tryed searching for next letter but am confused does anyone have a link to it please... |

if this last letter from them was in response to the TC846 form then you need to be moving on to the 2nd complaint and dispute, which is step 3 here http://www.taxcc.org/Dispute_1st_things_1st.html hopefully you have already done step 2; claiming your data, but if not, get that one done now too, and see what you can put together for the case history needed for step 3 before your data comes back.
question; did their response give a reason why they find it your fault. usually its something like "you should have noticed the error" or "you did not inform us of changes"
if they didn't give a reason, this is not a valid answer and i would write back and complain.
if they did give a reason, challenge this reason in the summary of the case history. i.e (if true) i did not receive awards notices to check or i rang in [xx] to inform you of the changes. etc etc |

Have a good browse around, sign the petition, download some flyers advetising us & print & distibute them.
Download our FREE Dispute Pack and - if you can afford to - please make a donation to our Fighting Fund. There are a good number of us here who have fought & won our cases sothere's really no need for us to still be here. However, we ARE still here and we're now fighting for YOU and all of the other folk who still have (alleged) overpayments.
We've been financing this ourselves, so I don't think it's unreasonable to expect a small donation now & then.
As you rightly say; HMRC have a standard letter telling you that you can't appeal. What they don't tell you is that you can DISPUTE & COMPLAIN.
Nor do they tell you that your MP has a direct line to them and MPs can - and do - sometimes get these things resolved.
