hiya, i'm due to have our second child early next year. my question is, will i still qualify for the childcare element of tax credits whilst on maternaty leave? if not, we'll have to take our 1 year old son out of a nursery that he loves and hope we can get him back in when i return to work. my thinking is that as i'll be off work anyway, i may not receive it. its kind of fair enough, but decent nursery care in our area is hard to find, our son was on a waiting list for 7 months to get him in.

hiya,

eligibility is not one of our strongest areas when it comes to TC, as the system is so different from all others, but i have just looked it up in the manuals, and this page here http://www.hmrc.gov.uk/manuals/tctmanual/TCTM02610.htm says that if you get Statutory Maternity Pay you ...

"are treated as being in work from the date these payments began, as long as they were in qualifying remunerative work (of at least 16 or 30 hours, whichever applies) before going on the maternity/adoption/paternity leave.....

A claimant who is already a parent before going on the ordinary maternity, ordinary adoption or paternity leave, can claim WTC if they worked at least 16 hours a week before the leave began. From April 2004 they can claim the WTC childcare element to help with the costs of eligible childcare for the new baby/child as well as for other children in the family."

Hi Laineybird

I think you are still entitled to the childcare payments whilst you are on maternity leave, but this is only my understanding and I would suggest you call the tax credit helpline. We mainly provide adivce on overpayments, kind of what to do when things have gone wrong, so have only limited information/guidance to give on this. I do know that there is an issue with maternity leave generating overpayments when you return to work and will try and find out the relevant link for you to get further information.

Apologies for not being able to give a better answer.

Can your son not carry on going to nursery while you are on maternity leave? thats what we did with my son this year when my wife was off on maternity leave carrying our baby daughter.. My son just kept going to nursery... It gave her a break too!
