Posted - 15/08/2008 : 11:55:27 hello there i am having major problems with my tax credits il start from the beginning its a long story but please read as i could do with some advise.
i had twins on 310707 last year and ohoned and reg them with child tax credit to update my award, i recieved a award notice but instead of having my eldest daughter listed and my two twins i had only my daughter and one baby listed with both my twins names on it
i phoned and told them of this error and was assured it had been updated. i then recieved another award notice about a month later with exactly the same error on it
i then wrote to them and explained fully yet again and then called around two weeks later and was told that there was delays but my account would be amended and that i would recieve all money due to me once the error had been updated
i then recieved an annual review pack and to my frustration the same error was on the award so despite my countless efforts for a whole year i have missed out on a baby entitlment
since then i have rang constantly to try and ressolve this and get a back payment they have made two referals but as of yet i have recieved no money they just keep saying that it is being looked at.
to make matters even worse my normal payments are manual due to there system not accepting my bank account even though its a normal high street current account.
they sent a referal through on july 30th how long can i expect to wait to get a payment for the year i have missed? i have been told that i should recieve the whole amount and not just 93 days due to me trying to sort the error for over a year !
i have wrote to the complaints manager but suprise suprise i have had no response
any advise??

I am not sure whether from what you say you have missed out completely on the baby element or have just received one baby element?
I believe you only get 1 baby element at any one time, so for twins you would only get 1 element.
However, if you have not received this at all, then you should appeal your latest incorrect award notice immediately. This is an issue of entitlement and as such you need to appeal on form WTC/AP.
Might be best to speak to a CAB or similar to get someone to check what is included and then help you write the appeal.

Posted - 15/08/2008 : 13:42:25 I agree with the Webmaster about contacting your MP. Point out to your MP that being on manual payments has caused you additional problems (not being able to get free prescriptions, dental treatment, council tax benefit etc) plus the inconvenience of having to cash them and then pay them into a bank account.
Calculate how much all this has cost you in terms of mileage, phone calls, postage, late payment fees for bills, bank charges etc as you are entitled to reimbursement of your expenses caused due to their errors. It might take a while to get this back and I would wait to submit your expenses until your claim is properly sorted but then you will hopefully have an extra payment to treat yourself and your family with.
Good luck, hang on in there, it looks like more people are winning their cases against HMRC all the time, and there is more and more stuff about their errors and incompetence appearing in the papers now.

Others will be along soon to help, but my first thought is that you should get your MP involved. They have an MPs Hotline to the Tax Credit Office, and the HMRC staff they speak to are normally more efficient than others.
