Hi

I received a letter from Overpayments at Cumbernauld on 25th June. Legal proceedings etc etc if we don't pay. I rang the helpline to tell them that I am in dispute and that I actually contacted a J Gibney at the overpayments team in preston on 21st April. This was to get him'her to answer some questions I had and to send me the Official Error Worksheet. To date he/she has not replied!!! I made sure the lad I spoke to on the helpdesk made of note of the lack of communication!!
I then wrote to Cumbernauld to tell them this. I also wrote to J Gibney...again, asking for the information I had requested. We have now had 4 different amounts of money requested. The lad on the helpdesk told me that the request for money owed for 05/06 had now been dropped...first I have heard of it!
Also on the same day we received our review for the year...once again they have my wifes working hours correct but don't have me working any hours at all. This despite the fact I informed them in writing two years ago when I started my current job!!!
If I get the information back from Preston I shall involve my MP. Is there anything else any can suggest I should be doing??

Presumably you've seen the home page (click 'Home' in the top right hand corner of the page above or click on www.taxCC.org )? There's a free downloadable Dispute Pack there.

Anything you get stuck on, either follow the 'Contact' section of the main website or post on here, and someone will either know, have some ideas, or be onto it. Main thing is, stick to your guns and don't let them grind you down, because they will have a jolly good try. In the end you should win. We could be talking months or years, though, so be prepared for that. Good luck!

And don't forget to keep a detailed log of everything you do (phone calls, letters, etc) together with all costs incurred (photocopying, postage, mileage to CAB etc) so that WHEN (not if!!!) you get your overpayment written off, you can claim back your costs.

Send your MP copies of the various requests for different amounts so that they can see for themselves the errors / incompetance about your claim, together with any other info showing that you are in dispute.

Never mind about if/when/whatever you get the paperwork or not - get your MP on your case NOW!!

Follow Robert's advice about getting your free dispute pack from our main site, fill-in the SAR request and this should get the documents you seek. If not you can make a complaint to the Data Commissioner.

Hi there. Don't wait to get your MP involved - get on to them right away. As Robert said, request your data and look at the dispute pack. There are also some great examples of letters others have written - in particular look for posts by resurgam (I think that's it?) I got some great letters of complaint from that thread - juts add in your own details as applicable. Will be writing more letters of my own this weekend and will put them up in my thread as examples.

There'll be other advice soon I'm sure!

Have you been to the home page link above,and dowloaded the dispute pack ?.. you will also need to get a sarn request going, this will give you the paperwork from your claim,and letters you may have sent. recordings of calls made,on screen notes from the TCO office .. and is FREE..but you will probably find like most, that the letter or call you want seems to be missing,it took me three tries to get the one i wanted..

Get your MP on the case, also try the CAB,the more the merrier..and write letters off complaint to the TCO office,making sure you write complaint in BIG bold letters on the envelope and on the letterhead.. and send a copy to your MP as well
