my problems go back to 02/03 and every year since.anyhow i am told by tax lot that i owe £3000 for over payments every year since 02/03. when i claim every april i never estimate our earnings i give the exact figure,when im awarded a sum i always ring to check its right which im always told everythings correct.how can i be over paid when i give the correct amounts.me and my husband split up a couple of times so ive claimed on my own as well,but only for a few months at a time.im told i owe £600 in 05 alone but ive been in touch with them about this this is the year they had my daughter down as claiming on her own she was infact 10!!.i never got this money only the money i was awarded.i did last year get in touch with them offering £40 amonth they said only accept £40 per week,i dont have any more spare money i thought when a offer was offered they had to accept.i cant afford £40per week has any one else been turned like this. please could someone help me with what im to do next,if anyone turns up at my door id die off thanks |

Your overpayment, could easily be caused by the histories on the children's details being incorrect. You seem quite tuned in, wth knowing what your income is, would you happen to know the exact dates of break up or date got back together?
This would be helpful as then once your SAR documents arrived you must check these dates are the same as what the system holds. You must concentrate on Claim start/end dates. Do they end then another starts the next day. Pay special attention to history behind any children's details. Do these correspond with other start stop dates. When children are present on a claim and if this claim ends because of the same reason as yours, break up or make up, then a child's details need to be ended on the same day as the claim end date. This is how you should see child's details
Name: Ella Sasha Bloggs
.......Start.............End
DOB: 13-09-1996
DOR: 13-09-1996.........16-03-2008
Then, the next fresh claim should have details for children like this
Name: Ella Sasha Bloggs
.......Start.............End
DOB: 13-09-1996
DOR: 17-03-2008
If any dates don't run in consistent format, ending one day and starting the next day, then this is where faults can occur.
Can I ask how much you were paid when you were single claimant every week.

The very least HMRC should do with every overpayment is offer a decent, understandable explanation of what went wrong. The fact this is never offered spontaneously and repayment is demanded from the outset is a shocking travesty of justice. In no other situation would demands be issued without there being any satisfactory explanation of how the problem arose. As a group, we cannot allow this situation to continue - where claimants or 'customers' are left completely powerless and held entirely to blame for recurrent and common mistakes that HMRC made.

Hi Mimme,
Robert is right - don't let HMRC bully you into paying, you don't even know if the figures are accurate. AS Robert advises look on our main site for how to dispute and submit a SARN request. Let HMRC know that you will be disputing repaying so that they put recovery on hold and get in touch with your MP who can help you fight this.
When did HMRC first tell you that you owed money? This is important as they only have 12 months from finalising a year's award to start recovery.

Dont be bullied into paying the HMRC any money at all. you need to dispute this to find out what has gone wrong, ie if there are errors due to HMRC incompetence,in which case you should not be made to pay.. the HMRC are good at getting there sums wrong on more that a few occassion namely 1.9 million per year..

Send all letters back by registered post, and mark then clearly as Complaint on the letter and the envelope..more will be along to give advice......good luck
