Hello newbie here.

Brief outline of my case is this;

Was on Working tax credit 2003/2004-due to my son living with me.
He began staying for more nights at ex partners house (his Mothers)
When the tax was due for renewal I didnt apply because We agreed my ex could apply instead.My business closed and I became unemployed.
I did not know but My ex had informed HMRC that he had been living with her-I only found this out when I was sent an overpayment notice in January 2005.its for following;
Overpaid working tax credit..........£2339.45
Overpaid Child Tax credit ...........£1221.95
Total...............................£3461.40

I sent a letter disputing this and said as far as I was concerned I had informed them all I was required to.

I then heard nothing until January 2007 it was from Inland Revenue recovery in Crewe threatening court action if I did not pay by 14 days.
I called their number and spoke to an advisor.She said I would be sent a form to fill out which I returned.
about 8 weeks later I got a letter to say they had looked at everything but still deemed that I had to pay it.
After telling them I was unemployed she told me it would be placed on hold for 6 months.
In late 2007 I got a call asking me to confirm that I was still unemployed,which I did.

I have heard nothing since then.

My question is this-I now want to sign off Jobseekers and my business advisor at the JC says he will do a fast track app for working tax credit.I have explained the circs of the previous claim and he says I should just wait and see.
Are they likely to still demand the payment ?
What level of it would they be taking ?
Do I just keep quiet and wait-or do I contact them and ask ?
Some advice on this would be appreciated

Yes you are correct-I did not send off the renewal after they sent it.
On that reckoning-this probably explains things as you have outlined.

Hi Matty,

I'm no expert, but if your Tax Credit claim is going to be a new one they can't reclaim the joint overpayment from your new claim. Which means that they will demand the whole amount, or a separate repayment arrangement from you.

If the overpayment came about because your ex informed HMRC that your son was living with her, why are they claiming working tax credit, as well as child tax credit, be repaid by you?

Also, you said that you didn't apply when the TC's were due for renewal ..... did you send them your Annual Return? If you didn't, they 'annul' the whole previous years TC's - it all becomes an overpayment!

Now, it may well be that they have given you the wrong reasons as to why your overpayment occured. They are infamous for spouting 'bull', and for constantly changing the amount of the overpayment.

My advice is that, when you have to, go through our dispute steps on the main website: http://www.taxcc.org/Dispute_1st_things_1st.html.

Thank you.I am actually a moderator on the consumer action group where I saw the link for here.
If I see any members who could benefit-naturally I will point them this way-and as we have over 230k members,doubtless there will be a few !!

Hi Matty and Welcome!!

This is just my personal view based on the fact that no matter what you tell them they'll only mess it up, so I would just keep my head down until they contact you again then I think I'd start a dispute process. (a case of letting sleeping wives lie if you like)

With a bit of luck we'll have a change of Government by then - and a change in this diabolical "system".

Other members will be along shortly to offer their views.

Meanwhile, we'd all be grateful if you could help spread the word about us to all your family & friends as it's very likely that one or two of them will be having troubles of their own with Tax Credits.
